The essence of the unique Merino foreclosure defense strategy is to require strict compliance by the bank with the laws controlling the negotiation of the promissory note from the bank that originated the loan to the bank that now seeks to enforce that promissory note and foreclose on the mortgage that secures payment of the promissory note.

The bank must be the actual and current owner and holder of the promissory note, as those terms are clearly defined by the law.  Just because the bank actually holds the note does not mean the bank is the actual holder of the promissory note under the law.

If the bank is not the owner and holder of the promissory note, the case will be dismissed—voluntarily by the bank or involuntarily by the court!
